Brokerage Agreement

Terms and Conditions

  • Galt Wine Cellars is neither a dealer nor a distributor for any specific brand nameGalt Wine Cellars accesses every reputable source available. Galt Wine Cellars does not "sell" equipment. Rather, Galt Wine Cellars evaluates its clients wants and needs, provides objective information to its clients, negotiates pricing with the dealer or distributor, and in all respects facilitates its clients’ purchase of wine storage equipment.

  • Your order authorizes Galt Wine Cellars to act on your behalf to purchase the merchandise or services you specify. In order to obtain the best pricing and fastest delivery available, Galt Wine Cellars places all orders and processes and remits client payments on the same day that client order confirmations are received. Payments made for merchandise and/or delivery charges are not refundable directly from Galt Wine Cellars. Prior to shipment, all canceled orders will be subject to a 10% administrative fee payable to Galt Wine Cellars. Production or shipping delays may arise from time to time with various vendors. Galt Wine Cellars assumes no responsibility and all restocking/cancellation fees will apply in such circumstances.

  • Defective or damaged merchandise is the responsibility of the manufacturer, distributor, or transportation company selected by the client. Warranties, refunds, and returns are matters exclusively between the client and the selected carrier, dealer or distributor. In the case of Galt’s own Extended Warranties (available on selected manufactured products such as Breezaire), Galt Wine Cellars does provide additional coverage, according to the OEM’s original terms. At the expiration of the original warranty period, Galt Wine Cellars does warrant such equipment through the 6th year, from date of purchase.

Galt Wine Cellars’ will, however, assist clients with these matters. Among more than 50 vendors, we are unable to control production or shipping schedules, nor can we provide warranties on the particular products or services. We can, however, assure every reasonable effort to resolve any service issues between a client and their vendor or carrier.

  • Galt Wine Cellars will assist its clients with the selection of delivery agents, coordinate factory shipping, and provide selected delivery agents with the necessary client information to complete the transaction. All rate quotes that a client receives from Galt Wine Cellars include full insurance. Galt Wine Cellars strongly recommends that all clients arrange full insurance coverage on all shipments not brokered through Galt Wine Cellars. "F.O.B." shipments become the responsibility of the client and their delivery agent at the point of pickup and the merchandise is deemed to be received by the client when received by its delivery agent.  INSPECT ALL SHIPMENTS FOR DAMAGE AT THE TIME OF DELIVERY!

  • If for any reason a client chooses to return merchandise, Galt Wine Cellars will assist the client in complying with the vendor’s return policies. Please note that most manufacturers charge a 10 - 20% "restocking fee" once production is begun and will require fully insured and prepaid return shipping before any credit is issued. Custom orders that are manufactured exclusively for one client’s unique specifications are not subject to refunds or returns.

  • By providing payment information and/or deposit, you acknowledge that you have read and agree to be bound by the terms and conditions included herein and authorize Galt Wine Cellars to purchase the selected merchandise on your behalf from the designated vendor. This Agreement constitutes the entire agreement between you and Galt Wine Cellars and may only be modified in writing signed by both parties any credit card refunds will be processed only by Galt Wine Cellars and subject to the above stated fees ("Chargeback" privileges are herein waived). This Agreement is made in Harris County, Texas and subject to the laws of the State of Texas. In the event litigation is brought to enforce the terms of this Agreement, such suit shall be filed in an appropriate court of jurisdiction in Harris County, Texas.

  • If special accommodations are required, Galt Wine Cellars encourages its clients to make such requests at the time of order.

By providing full or partial payment, you agree to the above terms in toto. We will assist with all service issues, but any refunds or warranty issues are the responsibility of the vendor, not Galt Wine Cellars.
